TERMS OF SALES
These conditions of sale are concluded on the one hand by the company CaroTisano with a share capital of Two Thousand Five Hundred euros whose registered office is located at 1B Rue Amand Brault 60370 Hermes, registered with the Trade and Companies Register of Beauvais under the number 90033449, hereinafter referred to as "CaroRtisano" and, on the other hand, by any natural or legal person wishing to purchase cement tiles, hereinafter referred to as "the Buyer".
Article 1: object
These conditions of sale aim to define the contractual relationship between CaroRtisano and the Buyer. The acquisition of cement tiles from CaroRtisano implies unreserved acceptance by the Buyer of these conditions of sale, which the Buyer acknowledges having read prior to his order. Before any transaction, the Buyer declares on the one hand that the purchase of cement tiles from CaroRtisano is not directly related to his professional activity and is limited to strictly personal use and on the other hand to have full legal capacity, allowing him to engage under these general conditions of sale.
The CaroRtisano company retains the possibility of modifying these conditions of sale at any time, in order to comply with any new regulations or for any other reason. Therefore, the applicable conditions will be those in force on the date of the order by the Buyer.
Article 2 - Products
The cement tiles offered by the company CaroRtisano, in particular on its website, are within the limits of available stocks. The CaroRtisano company reserves the right to modify the assortment of its cement tiles at any time. Each product is presented on the website in the form of a description containing its main technical characteristics. The photographs are as accurate as possible but do not commit CaroRttisano in any way. The sale of cement tiles presented on the CaroRtisano website is intended for all buyers residing in countries which fully authorize the entry into their territory of these products.
Article 3 - Rates
After the Buyer has requested a quote from CaroRtisano, the latter will send the Buyer a quote for the supply and delivery of the cement tiles requested.
The estimate will include the cost of the products and the cost of transport.
The prices will be indicated in euros (€), excluding taxes (HT) and all taxes included (TTC) taking into account the VAT applicable on the day of the order. Any change in VAT may be passed on to the price of the products.
Article 4 - Order and terms of payment
In order to place an order, the Buyer will be asked for a "good for agreement" to be affixed to the estimate and returned to CaroRtisano so that the order can be processed and validated.
The order will imply acceptance and without reservation of these general conditions of sale.
In addition, a 30% deposit will be requested when ordering and in the event of cancellation of the order by the buyer for any reason whatsoever, the 30% deposit paid will be retained to cover the costs incurred by CaroRtisano.
CaroRtisano reserves the right to refuse any order without having to specify the reason.
Payment can be made by bank check in the name of CaroRtisano or by bank transfer to the account of the company CaroRtisano.
The balance will be paid as soon as delivery is made within a maximum period of 30 days.
The Buyer is prohibited from claiming a complaint against the company CaroRtisano to defer all or part of its regulations. Except with the agreement of the company CaroRtisano, failure to pay invoices on their due dates will result in the payment of all sums remaining due regardless of the method of payment provided, as well as payment as damages and penalty clause. compensation equal to 10% of the sums due, in addition to legal interest and any legal costs.
Article 5 - Storage
CaroRtisano cannot be held responsible for the receipt and storage of cement tiles by the Buyer. Cement tiles are packed in cartons and delivered by cartons or by pallet. Cement tiles must be stored in correct conditions protected from bad weather. If this were not the case, the time for raising the milts would be longer than that indicated in the usual installation advice.
The installation must be carried out according to the rules of the art under penalty of degradation of the cement tiles.
Article 6 - Reservations
The prices, information and descriptions of our cement tiles, brochures or advertising are for information only and do not bind CaroRtisano in any way.
CaroRtisano reserves the right to make any changes it deems necessary.
The colors of the cement tiles may vary slightly as well as the graphics of the patterns. No warranty is given.
The implementation of our cement tiles is under the full responsibility of the Buyer. The company CaroRtisano would not be questioned.
Article 7 - Deliveries
Our delivery times are given for information only and cannot claim late payment penalties or total or partial order cancellation.
The reception of the goods corresponds to the signature by the Buyer of the delivery note.
Reception belongs to and is the responsibility of the Buyer, who must check the goods and note on the carrier's receipt note all observations noted (defect, poor condition, breakage, torn packages, etc.).
The unloading of cement tiles is the responsibility of the Buyer as well as their transport to the place where they will be laid.
Article 8 - Complaints
All claims for damage or non-compliance must be made to the company CaroRtisano by registered letter within 3 days from the date of delivery.
Section 9 - Transportation
The goods travel at the risk and peril of the Buyer regardless of the means of transport used or the methods of payment of the transport price.
Article 10 – Retention of title clause
The CaroRtisano company retains full ownership of the products sold until full payment of the price, in principal, costs and taxes included.
In addition, if the Buyer does not comply with the terms of payment or if he is the subject of legal proceedings or liquidation of assets (article of law n ° 85/98 of January 25, 1985 modified by Law No. 94./475 of June 10, 1994) the company CaroRtisano reserves the right to repossess the goods at the Buyer's expense.
Article 11 - Withdrawal
Under Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the order to exercise his right of withdrawal.
Article 12 - Settlement of disputes
These conditions of sale are subject to French law. For all disputes or disputes, the competent Court will be that of Beauvais.
